What exact liability insurance does a Florida child care center need?
A licensed Florida child care center requires specialized general liability insurance that explicitly includes coverage for abuse and molestation claims. Facilities also need commercial auto insurance for transport vans, workers compensation for staff, and professional liability for educators.
Child Care Center vs. Home Daycare Insurance
Florida law names two main kinds of child care, and the insurance follows the same line.
Child care centers
A child care facility cares for more than five children unrelated to the operator, for pay (§ 402.302(2), Florida Statutes). Centers carry general liability, abuse and molestation coverage, property and workers comp, plus commercial auto when they drive children.
Family day care homes
A family day care home cares for children from at least two unrelated families in an occupied residence (§ 402.302(8), Florida Statutes). A homeowners policy often limits or excludes business claims, so a home daycare needs a liability policy of its own.
Florida Daycare Insurance Requirements and Rules
Florida law says less about daycare insurance than most owners expect. These are the rules that do touch it.
| What Florida law says | What it means for your daycare |
|---|---|
| Child care facilities must meet the vehicle insurance rule of § 316.615(4): single-limit liability of $5,000 per seat or $100,000, whichever is greater (DCF Child Care Facility Handbook, § 2.5.4(D)) | Keep proof at the facility, as the handbook directs. A 24-seat bus needs at least $120,000. |
| Family day care homes are licensed where the county requires it and register with the state each year everywhere else (§ 402.313(1), Florida Statutes) | Carriers ask whether you are licensed or registered, and how many children you keep. |
| Child care that is an integral part of a church or parochial school can be exempt from licensing, but must still meet screening and safety rules (§ 402.316(1), Florida Statutes) | An exempt program still needs liability coverage. Our church insurance page covers the congregation's side. |
| A child care business with four or more employees needs workers comp (§ 440.02(20)(b)2., Florida Statutes) | Teachers, aides and cooks all count, part-time staff included. |
These are the rules, not legal advice or a quote. Parents and landlords usually set the liability limit you need.
Daycare Business Insurance, Part by Part
Four coverages make up most daycare programs. Each one answers a different kind of claim.
General liability
Pays when a child or a parent is hurt on your property, and pays for your defense. Parents and landlords ask about this one first.
Abuse and molestation coverage
Many general liability policies exclude these allegations, so child care programs add the coverage back by endorsement or with a separate policy.
Accident medical for children
Pays small medical bills after a fall on the playground, without anyone having to prove fault. Parents see it as a sign of a careful program.
Commercial auto for daycare vans
Vehicles that carry children belong on a commercial auto policy that meets the § 316.615(4) limit, with every driver listed.
